Confusingly similar

Confusingly similar is the first test in a UDRP complaint. It asks whether the domain name is close enough to a trademark that the mark is recognizable in it.

Why it matters

Panels compare the domain with the mark side by side. If the whole mark, or its main part, appears in the domain, the test is usually met. Adding words like shop or a typo does not avoid it. The test is only a threshold. Strong defenses come later, under rights or bad faith. A common mistake is thinking a similar name is safe if the content is different. The test looks at the name, not the website.
